Requested Action:

Recommendation

It is requested that the Board of County Commissioners authorize: 1) Execution of SJRWMD cost-sharing agreements 39078, 39079, 39089, and 39278; 2) Permission to execute grant amendments and modifications upon review and approval by the County Attorney’s Office, Risk Management, and Purchasing Services; 3) Permission to execute all competitively procured construction and Construction Manager at Risk (CMAR) contracts, amendments, and change orders; and 4) Associated Budget Change Requests.

Summary Explanation and Background:

 

The four projects associated with these cost-sharing agreements will reduce nutrient loads to the Indian River or the Banana River Lagoons.  The Department of Environmental Protection (DEP) granted SJRWMD $6,997,962 for 15 specific Indian River Lagoon Stormwater Improvement projects through DEP Agreement MN034. Not all of the 15 projects are under the jurisdiction of Brevard County. Of the eight Brevard County projects, only Task No. 1 (Kingsmill-Aurora II, 39079), Task No. 2 (Sand Dollar, 39089), Task No. 9 (Pioneer, 39278), and Task No. 15 (Flounder, 39078) listed in Attachment 3 of each SJRWMD/County cost-share agreement are proposed for Board execution as part of this agenda item. The County’s other four MN034 Tasks (projects) have been or will be presented to the Board separately.

The Pioneer and Flounder projects are almost bid-ready.  However, the other two projects’ designs are not complete and the grants require contracting for construction to be completed by December 2024.  The County has CMAR firms under contract that NRM can employ. Utilizing CMAR firms will allow the county to meet the grant contracting deadline requirement.

 

Cost-share agreement 39079 contributes funding to the Kingsmill-Aurora Phase II project. This project consists of the construction of two stormwater ponds, that will be used to reduce nutrient discharges that flow to the Eau Gallie River, eventually leading to the Indian River Lagoon.  The estimated reduction in nitrogen (N) is 4,176 lbs/year.  SJRWMD cost-share funding amount is not to exceed 82.48% or $1,200,000, whichever is less, of the total construction cost ($1,455,000).


Cost-share agreement 39089 contributes funding to the Sand Dollar Canal project. This project involves the construction of a gabion-based denitrification system within a canal before its discharge, which will reduce nutrient discharges to the Indian River Lagoon.  The estimated reduction in nitrogen (N) is 444 lbs/year.  SJRWMD cost-share funding amount is not to exceed 100% of the total construction cost or $1,500,000, whichever is less.

 

Cost-share agreement 39278 contributes funding to the Pioneer Road Denitrification project.  This project provides for the installation of an underground treatment chamber filled with biosorption-activated media as an in-channel denitrification system to remove nitrogen and a vegetation diversion system to enable the removal of floating freshwater vegetation from the roadside channel which will reduce nutrient discharges to the Banana River Lagoon.  The estimated reduction in nitrogen (N) is 105 lbs/year.  SJRWMD cost-share funding amount is not to exceed 100% of the total construction cost or $645,000, whichever is less.

 

Cost-share agreement 39078 contributes funding to the Flounder Creek Pond Denitrification Retrofit. This project consists of the installation of a denitrification bioreactor at the outfall of an existing pond. The system will contain biosorption-activated media that will reduce nutrient discharges to the Indian River Lagoon.  The estimated reduction in nitrogen (N) is 856 lbs/year.  SJRWMD cost-share funding amount is not to exceed 39.88% or $157,500, whichever is less, of the total construction cost of $395,000.

 

All projects are currently included in the FY 23-24 Capital Improvement Project Budget. The increase in grant funds offered will provide savings of Stormwater fees and Save Our Indian River Lagoon cost-share previously approved by the County Commission for these projects.
