Authorization to permit the rental of County-owned Parks and Recreation Department Community Centers for commercial gun shows.

Summary Explanation and Background:

It is requested that the Board consider the rental of County-owned Community Centers to commercial organizers wishing to hold/sponsor commercial gun shows.  The gun shows would be open to the public.  This is a Category VI Commercial activity, and fees will be assessed per the Parks and Recreation Department Fee Schedule. 

All Organizers shall:

1.                     Comply with all federal, state and local laws.

2.                     Organizer will post appropriate signage  to inform the public of the activity occurring in the Community Center.

3.                     Execute a Contract with the County for the event.

4.                     Submit a security plan to include a minimum of 1 ATF agent and 1 additional law enforcement officer to be onsite while firearms are on the premises.

5.                     Ensure firearms to be displayed or sold in the Community Center are cleared of ammunition and tagged for identification purposes.

6.                     Provide a minimum of $2,000,000 general liability insurance naming Brevard County Board of County Commissioners as an Additional Insured.

7.                     Provide any additional insurances as required by Risk Management.

8.                     Not permit any person under the age of 16 years of age in the Community Center unless accompanied by a parent or legal guardian.

9.                     Acknowledge that all personal property placed on Brevard County property shall be at the risk of the Organizer and the Organizers vendors and participants.

In addition to the above requirements, options for the Board to Consider:

Option 1.                     No activities, unrelated to the gun show, are permitted in the same room(s) as those occupied by the gun show.  Activities, for other groups, must be in physically separated rooms from the gun show.

Option 2.                     Displace Recreation Partner programs with 90-days’ notice.  Staff shall make all reasonable efforts to find a nearby equivalent or substantially similar alternate location for the Recreation Partner or offer to re-schedule the program if the specific location is demanded.  Pre-existing, pre-booked rentals would not be displaced.  Organizer shall rent the entire Community Center.  There would be no concurrent Center use and the event organizer has sole possession of the building.  Should the BOCC wish to pursue this option, the BOCC may wish to consider whether to apply it not only to gun shows but to all events.

Option 3.                     Identify Community Centers in the North, Central (e.g. Kiwanis Island Park) and South area that have separated buildings so a gun show would be in a different building so as not to come in contact with programs, activities and rentals. Organizer shall rent the entire building.  There would be no concurrent building use and the event organizer has sole possession of the building.
