Approval of this action will result in a savings from North Area Parks Operations Fund 1010, Cost Center 250410. The Contractor estimates the project to be under $100,000.

Recommendation

It is requested the Board of County Commissioners authorize the Chair to execute all related contracts, upon Risk Management and County Attorney’s approval and authorize the County Manager to execute necessary Budget Change Requests related to the dock reconstruction and channel dredge at Kennedy Point Park.

 

This action requires a super-majority vote by the Board pursuant to Code Section 2-247 Non-Competitive lease or sale of county property.

Summary Explanation and Background:

Kennedy Point Park is a 5.38-acre community river park featuring a paved shoreline walkway with bench seating; a boat ramp with a dock; pavilion, restrooms and a large parking area for both vehicles and boats.

The existing dock received damage during Hurricane Irma and has been closed to the public.

The Parks and Recreation Department has a final site plan for the project and has obtained required permits from the United States Army Corps of Engineers and St. Johns River Water Management District.  Oliver Companies, Inc. approached the Parks and Recreation Department indicating its desire to complete the project at their sole expense per the permit specifications on behalf of the County.

The scope of the project includes:

                     Demolition of the existing dock and construction of a new dock by replacing pilings, cross supports, stringers and decking

                     Construction of a settlement basin outfall structure and discharge piping

                     Dredging of 5 feet to Mean High Water Line to channel (approximately 881 Cubic Yards)

                     Dewatering and hauling all dredge spoils offsite to a Florida Department of Environmental Protection Agency approved disposal site

                     Adherence to sediment and erosion control requirements using silt fence, turbidity barriers, hay bales and other erosion controls as required for site conditions and approved by the County

                     Any other work required under the permits issued to the County

                     Final Project Completion is anticipated 180 days after the issuance of the Notice to Proceed

A joint staging area will be utilized for both the County’s project and the Contractor’s construction of a proposed hotel and convention center.  The Contractor will install a screened fence enclosure around the staging area and will be responsible for maintenance and securing the enclosure.  The Contractor will have the right to use the staging area for a term of two years.

Completion of this project will mutually benefit the County and the citizens of Brevard County by re-opening the Park and providing a wonderful boating experience for all.

 

The Construction Management Services Contract requires the Chair to execute the contract due to the cost associated with the project. The Construction Management Services Contract has been reviewed and approved by both the County Attorney’s Office and Risk Management.

 

Brevard County Code of Ordinances, Chapter 2, Section 2-241 through Section 2-251, establishes procedures for the sale, leasing and donation of real property.  It requires the intent and County Code to be published on the County Internet Website at least 5 days prior to the public meeting and also requires a supermajority vote by the Board.  The posting requirement was successfully completed on January 31, 2020.
