It is requested that the Board of County Commissioners:
1. Review and approve revisions to Board of County Commission Policy 76 - Caretakers; and
2. Authorize the Chair to sign the revised policy.

Summary Explanation and Background:
Numerous Departments within the Brevard County Government organizational structure previously used Caretakers to reside at and provide security and other services at County facilities. The Parks and Recreations Department (P&R) is currently the only department (including the Environmentally Endangered Lands program) that uses Caretakes. The Department sees benefit from these arrangements and would like to continue to utilize Caretaker License to Occupy Agreements, which do not confer a leasehold, tenancy, or real property interest. These agreements would be for 5 year terms, are revocable licenses to occupy the property, and include language for termination for convenience.
P&R uses Caretakers to provide security services at a county park or property in exchange for the opportunity to either place a modular home or to occupy a county-owned dwelling and to use the immediate premises in a residential capacity. Caretakers will pay either a reduced licensing fee (if utilizing a county-owned dwelling) or reduced lot license fee (if utilizing their own modular home). The License to Occupy Agreements include annual fee escalators.
These changes in BCC-76 allows P&R to assume oversight of the policy, makes changes consistent with P&R operations (for example, referencing background screening and Department Standard Operating Procedures (that change from time to time)), and allows the Department Director to sign future Caretaker License to Occupy Agreements...
