Requested Action:

Recommendation

 It is requested the Board approve the Fire Protection and Rescue/Emergency Services Agreement with 4 Communities Fire Department (FCFD), Merritt Island Volunteer Fire Department (MIVFD), and Mims Volunteer Fire Department (MVFD).  There are no substantive changes from the previous agreements, which has been fundamentally the same for the last 28 years.

Summary Explanation and Background:

On March 9, 1978, the County adopted Ordinance No. 78-07, which authorized the execution of an agreement with the Volunteers for the providing of fire protection and rescue/emergency services within the unincorporated areas of Brevard County.  The agreements between 4 Communities Fire Department (FCFD), Merritt Island Volunteer Fire Department (MIVFD), and Mims Volunteer Fire Department (MVFD) allow call response for assistance when BCFR is unavailable or as backup supplement to BCFR, valuable component of BCFR’s field operations. 

 

On September 22, 2020, the Board approved a 90-day extension to December 31, 2020, to provide staff the time necessary to negotiate new agreements.   Core components of the contract remain unchanged; there are minor administrative changes and standard county contract clauses that address insurance and indemnification.   Both BCFR and each Volunteer Department agree on the new language. 

 

All agreements have been uniformly updated and shall terminate on September 30, 2023.  The contracts shall have two (2) one (1)-year extensions by mutual agreement of both parties.
