It is requested that the Board of County Commissioners approve and authorize the Chair to execute the agreement to amend the sewer service agreement with the City of Titusville to service Manatee Hammock campground.

Summary Explanation and Background:

Brevard County and the City of Titusville previously entered into a 30-year sewer service agreement on August 16, 1994, wherein the City agreed to furnish or have available 14,200 gallons of sewer service per day to the County for the benefit of Manatee Hammock Campground as an out-of-city applicant.  The County installed sewer lines with excessive capacity to serve potential third-party customers with the understanding that such third-party users would reimburse the County an equitable portion of the cost of extending the sewer line with excess capacity.  In a subsequent amendment dated August 8, 1995, the rate calculation for equivalent residential connection was modified.  This amendment will establish that the reimbursement obligations in the agreement shall remain in effect for an additional thirty (30) years from the date of execution of the agreement and properly recorded as a public record at the expense of the County, and that all other terms and conditions of the agreement shall remain in full force.
