The estimated McKinsey & Company Settlement for Brevard County is $304,098.31. Final settlements from the various settlement are unable to be determined at this time.

Recommendation
It is requested that the Board of County Commissioners:
(1) Approve participation in the new opioid settlements agreements for Purdue (and certain of its affiliates) and the Sackler family, Alvogen, Amneal, Apotex, Hikma, Indivior, Mylan, Sun, and Zydus;
(2) Accept the McKinsey & Company settlement agreement;
(3) Authorize the County Manager or designee to sign future Subdivision Participation (opt-in) and Release Forms, settlement agreements and to take all other necessary action required by these settlement agreements upon approval of Outside Counsel, the County Attorney's Office, and Risk Management; and
(4) Authorize the County Manager to execute all necessary budget amendments (BCRs) relating to all opioid settlement funds received by Brevard County.

Summary Explanation and Background:
On May 18, 2021, the Board of County Commissioners (BoCC) authorized Resolution 21-071, which committed the County to participating in the State of Florida's Memorandum of Understanding regarding the use and distribution of opioid settlements funds (the Florida Plan). The State of Florida has agreed to multiple opioid settlements. These Settlements require subdivisions in the State of Florda to take affirmative steps to participate in the Settlements with manufactures and distributors.
