Summary Explanation and Background:
The applicant is seeking a change of zoning classification from AU (Agricultural Residential) to RU-1-11 (Single-Family Residential) for the purposes of legitimizing an undersized parcel and subdividing that parcel into three lots to build three single-family homes. The subject property was two undersize AU zoned parcels. A 0.275-acre parcel and a 0.624-acre parcel. The 0.275 acre was subdivided into its size configuration on November 09, 1982. The 0.624 parcel was subdivided into its size configuration on July 08, 1964. The parcels as they existed did not meet the minimum AU size requirements at that time, and therefore cannot be considered non-conforming lots of record. Both parcels were combined as a single parcel per warranty deed recorded on December 16, 2025, in Official Records Book 10504, Pages 227-232.

The applicant is on notice that subdividing the subject property into three parcels may require an approved Subdivision plan pursuant to Chapter 62, Article VII, Brevard County Code of Ordinances (see also Section 62-1188, Brevard County Code of Ordinances, stating in pertinent part "if two or more lots or a combination of lots and portions of lots with contiguous frontage in single ownership are of record, and if all or part of the lots do not meet the requirements for lot width, lot area and lot depth as established in this section, the lands involved shall be considered to be an undivided parcel for the purposes of this chapter").
