It is requested that the Board of County Commissioners approve and authorize the Chair to execute an Amendment of Encroachment Agreement between Florida Gas Transmission Company, LLC and the Board of County Commissioners, Brevard County, Florida, granting Florida Gas Transmission conditional permission to construct an access gate to the pipeline easement transecting the US192 Solid Waste Management Facility property.

Summary Explanation and Background:
On December 5, 2023, the Board of County Commissioners approved and authorized the Chair to execute an Encroachment Agreement Between Florida Gas Transmission Company, LLC and the Board, granting Brevard County conditional permission to construct within the area of the gas transmission easement on the US192 property. Following the County construction activities, it was found that access to the eastern portion of the pipeline easement had been blocked by fencing. Florida Gas Transmission has prepared an Amendment to the Encroachment Agreement to allow for the construction of a gate to facilitate access to the pipeline easement. The gate will be constructed and maintained by Florida Gas Transmission at no expense to Brevard County.
The Amendment of Encroachment Agreement provided by Florida Gas Transmission is consistent with those that the County has signed in the past and the Amendment has been reviewed by the County Attorney’s Office and Risk Management (AO-29 attached).
