Fiscal Impact:
Overall, positive impact due to less staff time to explain equivalent materials and acceptable construction practices. It will also provide alignment between the Code and the County approved Pavement Management Program. These changes will provide clearer expectations for developers and contractors, and ensure the improvements are being constructed in accordance with updated standards.

It is requested that the Board of County Commissioners approve legislative intent and permission to advertise amendments to Chapter 62, Article VII, Division 1, Section 62-2802, entitled Exhibits, Brevard County Code of Ordinances.

Summary Explanation and Background:
Section 62-2802, Brevard County Code of Ordinances, provides minimum requirements for construction geometry, materials, and methods associated with development. Section 62-2802 provides as follows: "[t]he exhibits, 1 - 26, referred to in this article and adopted by reference and incorporated herein are part of this article and article VIII. The language of this article and article VIII shall control in the event of conflict between any figure contained in an exhibit." These exhibits, however, have not been updated since 2008. Currently, many of the material references for asphalt and concrete are no longer commercially available or applicable, requiring staff to provide additional guidance to developers and contractors regarding acceptable equivalent materials.
