Recommendation

It is requested that the Board of County Commissioners provide direction regarding the request made by the Tourist Development Council that the Board direct the County Attorney’s Office to seek a State of Florida Attorney General opinion regarding whether the use of Tourist Development Tax to pay for lifeguards in Brevard County is appropriate and legal.

Summary Explanation and Background:

At the September 24, 2024 Board of County Commissioners meeting, the Board voted 3-2 to allow the use of Tourist Development Tax to pay for lifeguards in the following amounts:

 

$300,000 from the Cultural Fund

$710,000 from the Capital Fund

$556,393 from the Marketing Fund

 

The Tourist Development Council at their September 25, 2024 meeting voted 5-1 to request the Board direct the County Attorney’s Office to seek an opinion from the State of Florida Attorney General as to whether this is an appropriate and legal use of the Tourist Development Tax in Brevard County.
