Summary Explanation and Background:
On August 06, 2026, the Board approved a change of zoning from AU to BU-1 with a BDP. Specifically, the requested uses include:
• Provide a 50-foot natural vegetative buffer along the northern boundary of the property and a 100-foot natural vegetative buffer on the eastern boundary of the property.
• Developer shall locate the retention pond on the northeastern portion at the back of the property.
• Prohibiting automotive sales and storage, bait and tackle shops, billiard rooms, electronic arcades, group homes (Level I, II), non-overnight commercial parking, gasoline service station.
• Developer shall limit ingress and egress to U.S. Hwy 1.
• No authorized deliveries before 6:00 a.m. or after 9:00 p.m.
• Free standing signage shall be located on U.S. Hwy 1 frontage only.
Staff has reviewed the BDP and determined it meets this criteria.
A BDP (Binding Development Plan) is a voluntary agreement presented by the property owner to self-impose limits upon development of a property in support of the change of zoning or conditional use permit. Pursuant to Section 62-1157, a BDP shall be recorded in the public records within 120 days of the Board’s approval of the zoning request. Following staff and legal review, the BDP is presented to the Board in recordable form as a Consent Agenda item to finalize the zoning action.
Clerk to the Board Instructions:
Upon recordation, please return one certified copy of the BDP to Planning and Development.
