It is requested that the Board approve legislative intent and permission to advertise an ordinance creating the Brevard Barrier Island Area Land Authority and direct staff to draft the ordinance.

Summary Explanation and Background:
The Brevard Barrier Island Area of Critical State Concern was designated by the Florida legislature due to it being "one of the most fragile and endangered coastal ecosystems in North America" and "some of the most fragile and endangered natural upland communities in the state and nation" (F.S.S 380.0533). This designation clearly demonstrates the unique nature of the area and the need to take proactive measures to preserve and protect the community.
Section 4 of the Brevard Barrier Island Act describes the boundaries of the Area, setting the northern boundary as "the southern boundary of the Town of Melbourne Beach" and the southern boundary of the Area of Critical State Concern as "the southern boundary of the Sebastian Inlet State Park." If ultimately adopted, the ordinance would only apply to the portion of the Area of Critical State Concern located within the jurisdictional boundaries of Brevard County.
F.S.S. 380.0663 authorizes a county with an area of critical state concern to create a land authority with abilities including, but not limited to, carrying out analyses of land planning needs and ways of meeting those needs, acquiring real property, assisting in the administration of state and federal grants, issuing bonds, and engaging the services of private consultants.
