Recommendation
It is requested that the Board of County Commissioners approve Legislative Intent, direct staff to prepare an ordinance implementing such intent, and grant permission to schedule and advertise the ordinance for public hearing. The proposed ordinance will amend the Historical Commission's membership requirements found in Section 58-37(a) to provide for appointment of members at-large, rather than by district residency. This amendment will allow a commissioner to appoint a resident who is knowledgeable in the history, cultural lore, and development of Brevard County regardless of the commission district in which they reside.

Summary Explanation and Background:
Currently, County Code provides for a 15-member historical commission "...consisting of three residents of each of the county commission districts of the county appointed by the board of county commissioners." Considering the specialized nature of this advisory board's duties and the limited applications to fill vacancies, the commission district residency requirement is burdensome.

On January 9, 1996, the Brevard County Board of County Commissioners unanimously approved an amendment to the language that read, "Each County Commission District shall select three residents of Brevard County..." which eliminates the district-specific residency requirement. Though approved unanimously, this ordinance was never executed by the Chairperson at the time. A significant period has passed since this vote and the ordinance has since been amended, necessitating reconsideration by the Board.
