It is requested that the Board of County Commissioners approve and authorize the Chair to:
1) execute the attached Resolution, As-Is Contract for Sale and Purchase, and County Deed, and
2) authorize the County Manager to execute all closing documents related to the sale.

Summary Explanation and Background:
The subject property is located in Section 11, Township 27 South, Range 37 East, east of South Patrick Drive, and west of Bella Coola Drive in Indian Harbour Beach.

The Utility Service Department is designing improvements to Lift Station B-20, at 212 Riverside Park Dr., Indian Harbour Beach, to increase its capacity. Lift Station B-20 was originally built in 1986 and has remained mostly unchanged since then.

As part of the design process, a boundary survey of 212 Riverside Park Dr. was completed, and the fence on the east side of the property was found to be located 28 to 30 feet into the Brevard County property from the property line. For the Lift Station B-20 Improvements, the Department needs to fully utilize the entire property, which involves relocating the fence to the property line, except for that portion shown in Exhibit A.

When the Department notified the affected adjacent property owners of their intentions to relocate the fence, a conflict at 212 Bella Coola Drive was identified, where a screened pool enclosure is approximately four inches from the property line.
