Recommendation
1. Approve and authorize the Chairman to execute the Non-Competitive Lease Agreement and Resolution;
2. Authorize the Parks and Recreation Director to sign future agreements, amendments, and modifications upon County Attorney and Risk Management approval.

Note: Approval of this action requires a majority plus one vote.

Summary Explanation and Background:
The Bit and Spur Club of Central Brevard, Inc., an equestrian club, and Brevard County initially entered into a Lease Agreement in January 1994. The County acquired the 17.3-acre property, located at 757 Friday Road, Cocoa, Florida, Parcel ID 24-35-27-00-5, in 1993. Prior to the acquisition of the property by Brevard County, the previous owner had allowed Bit and Spur Club of Central Brevard, Inc. to utilize the property for equestrian activities. The Bit and Spur Club of Central Brevard, Inc. has developed numerous permanent facilities including a lighted show ring, an announcer building, a restroom facility, a screened-in pavilion, bleachers, and a stabilized parking area. Bit and Spur Club of Central Brevard, Inc. provides on-site security with a caretaker who resides in the caretaker's personal mobile home and maintains the property.

The Bit and Spur Club of Brevard County, Inc. provides insurance liability coverage. Brevard County does not have any maintenance or utility expense responsibility for the property. This non-competitive Lease Agreement is for five (5) years with an additional five (5) year term ...
