Recommendation

It is requested that the Board of County Commissioners hold a public hearing and consider adopting the amendments to Brevard County Code of Ordinances Chapter 94 - Solid Waste.

Summary Explanation and Background:

On July 9, 2024, the Board of County Commissioners in regular session conducted a Public Hearing and adopted Ordinance 24-12, amending Brevard County Code of Ordinances, Chapter 94, Solid Waste.

 

Due to a clerical error, only the portions of Chapter 94 being amended were included in Ordinance 24-12.  Thus, any sections that were not amended have been removed from the Ordinance.  Ordinance 94 requires an amendment to replace all removed content that was intended to remain.

 

The proposed amended Brevard County Code of Ordinances Chapter 94 - Solid Waste would accomplish the following:

 

                     Replaces omitted definitions (94-1).

                     Replaces omitted paragraphs concerning violations of the Ordinance and penalties (94-4).

                     Replaces omitted paragraphs concerning the collection point location and time solid waste receptacles can be left at the collection point (94-47).

                     Replaces omitted paragraphs concerning limited exemptions for the disposal of construction & demolition debris or incineration of landclearing debris (94-76).

 

This ordinance has been developed with and approved by the County Attorney’s Office and has met all legal advertising/noticing requirements.

Clerk to the Board Instructions:

Upon approval by the Board, execution by the Chair, and attestation by the Clerk, file the ordinance with the Department of State as required by law within the 10-day deadline.  Please return a copy of the executed ordinance with the Department of State’s official acknowledgment to the County Attorney’s Office.
