Fiscal Impact:

If approved, the project will be exempt from $510,351.50 in Educational Facilities Impact Fees for a period of fifty years.

Recommendation

It is requested that the Board of County Commissioners approve the Educational Facilities Impact Fee Exemption Contract for the Sunset Palms Development Community in accordance with Sections 62-921 through 62-935 of the Brevard County Code of Ordinances, and authorize the Chair to execute the contract.

Summary Explanation and Background:

The Sunset Palms Development Community project consists of two hundred and sixty-three (263) multifamily rental units, deed restricted to people sixty-five (65) years of age or older, located within the jurisdiction of The City of Palm Bay.  Should the Board approve the agreement, it would require the developer to record an additional deed restriction limiting all residents to 65 years or older (the current restriction allows for low income or 65+).  Given the agreed-upon restriction, the project is exempt from the requirements of school concurrency and educational facilities impact fees pursuant to Section 13.1(d)4 of the Interlocal Agreement for Public School Facility Planning & School Concurrency and Section 62-933(a)(6) of the Brevard County Code of Ordinances. 

 

All remaining impact fees pertaining to this project will remain due and payable pursuant to the land development regulations of the County and the City.
