Fiscal Impact:
There is no Fiscal Impact in approving the Federal Certifications and Assurances; however, if the Board chooses not to approve the Certifications and Assurances, Space Coast Area Transit will be unable to draw Federal Transit Administration (FTA) funding. Current apportionments to Space Coast Area Transit for Fiscal year 2026 total $11,258,725.

Recommendation
It is requested that the Board of County Commissioners approve and authorize the Chair to sign the Fiscal Year 2026 Certifications and Assurances for Federal Transit Administration Grants. It is further requested that the Board authorize the Transit Director to Execute the Certifications and Assurances electronically.

Summary Explanation and Background:
As the designated grantee for Federal Transit Administration (FTA) funding, Brevard County is required to execute the annual Federal Transit Administration Certifications and Assurances to remain eligible to draw Federal Funds. The certifications outline twenty (20) categorical mandates that must be complied with, including: Purchasing and Procurement, Safety Plans, Transit Asset Management Plan, Alcohol and Controlled Substance Testing, State of Good Repair, Enhanced Mobility of Seniors and Individuals with Disabilities Programs, among other certifications and assurances.
The Certifications and Assurances are a mandatory pre-award requirement and must be approved and signed within 90 days, of the April 9, 2026, publication date. Failure to meet this deadline will delay or jeopardize the disbursement of over $10 million in annual federal funding. The capital and preventative maintenance budgets for Space Coast Area Transit are funded entirely by these federal allocations.
By signing the Certification and Assurances, Space Coast Area Transit is obligated to meet several Federal requirements such as Drug and Alcohol Testing, Federal Procurement Regulations, Safety Plans etc. While the exact cost of complying with these mandates has not been determined by a formal study, it is estimated that annual expenses range from $250,000 to $350,000. These costs are fully reimbursable through State and Federal Grants.
