It is requested that the Board authorize the County Manager to execute all contracts, contract amendments, and any contract extensions, budget change requests (BCR), change orders, amend the five-year Capital Improvements Plan (CIP) as it relates to this project, and any documents, reimbursement requests, or other administrative actions related to this agreement, upon review and approval by the County Attorney’s Office, Risk Management, and Purchasing Services.

Summary Explanation and Background:
In 2022, the Utility Services Department received two grants for wastewater collection system improvements for the South Beaches service area. The grants are from the following: (1) FDEP resiliency grant in the amount of $14M, and (2) ARPA allocation in the amount of $1.8M for the design phase only. All projects associated with the above-mentioned grants are to improve the infrastructure resiliency of our wastewater collection system in the South Beaches service area.
During the due diligence phase of developing projects associated with the above-mentioned improvements, it was determined using a hydraulic model, that a 30-inch parallel force main along South Patrick Drive from our Lift Station B-20 to south of Eau Gallie Boulevard was identified as a high-level solution to reduce the probability of wastewater discharges. Coincidentally, FDOT has a programmed roadway resurfacing project (FDOT Project No. 44879-1) along South Patrick Drive from Pineda Causeway to Eau Gallie Boulevard.
As soon as this Department became aware of this overlap of projects, this Department reached out to FDOT to determine means of working together to accomplish both projects during the same construction timeline. We have been working with FDOT for the past five months on how to implement these projects successfully. It was decided by all parties that installing a portion of the County’s proposed 30-inch force main project at the intersection of South Patrick Drive and Banana River Drive (Attachment A) was the best path forward. The advantages of combining the two projects are it becomes more feasible to hire a single contractor who mobilizes once versus hiring two contractors to be mobilized at different times which would include redoing road resurfacing upon the completion of each phase. This will also result in a more condensed timeline, reducing the impact on the local travel community.
As part of the terms associated with the UWHCA agreement with FDOT (Attachment B), FDOT requires that the $1,125,519.49 (Attachment C), construction cost estimate, and 10% contingency, be forwarded to FDOT before acceptance of an executed contract. The construction bid will include specific construction bid items specific only for Brevard County as a means of transparency of what portion is being paid by the County. If the bid for the utility work portion of the project comes in over the $1,125,519.49 value of the estimate plus 10%, the Utility Services Department has the option to not proceed with the project and receive our money back.
This project was approved as part of the Annual Capital Improvement Project for FY 24-25 (Attachment D).
