Summary Explanation and Background:
On February 5, 2026, the Board of County Commissioners held a public hearing and considered a request for a change of zoning classification from RU-1-13 to AU(L) on property owned by Lazy River Investments, LLC., application number 25Z00049. The Board voted to deny the request by a unanimous vote and directed the County Attorney’s Office to prepare findings of fact. The requested Resolution setting forth proposed findings of fact, conclusions of law, and the action taken is attached.
Pursuant to BCC-51, when the Board directs the County Attorney to develop a resolution setting forth proposed findings of fact, the resolution is to be scheduled for approval as a consent agenda item at a subsequent regular meeting of the Board. If the Board removes the resolution and findings of fact from the consent agenda for discussion at a regular meeting, the discussion shall not constitute a reopening of the public hearing, nor shall the Board hear any new evidence from the public. BCC-51 does not, however, prevent the Board from continuing a public hearing to a date certain and reopening the public hearing at that time. In the event the Board wishes to reopen the public hearing, the item shall be readvertised.
