Recommendation
It is requested that the Board of County Commissioners:
1) approve and authorize the County Manager to execute the Interlocal Agreement with the City of West Melbourne for the Sheridan Road Sidewalk Improvements;
2) authorize the County Manager to execute any necessary agreement-related documents, such as amendments, contingent upon review and approval by the County Attorney’s Office, Risk Management, and Purchasing Services; and
3) authorize the County Manager to approve any Budget Change Requests associated with this action.

Summary Explanation and Background:
The County has a capital improvement project to construct sidewalk improvements on Sheridan Road between West Sylvan Drive and Wickham Road. A portion of these improvements lie within the jurisdiction of the City of West Melbourne from the east side of Orange Grove Ave (south side of Sheridan) to just west of Wickham Road.
The County’s responsibilities under the proposed ILA include managing the design and construction. Additionally, it also has the authority to enter into appropriate contracts to perform the work associated with the project. The City has agreed that the County will be the lead agency. The City agrees to fully cooperate with and supports the County’s work efforts associated with the project and will have the opportunity to review and approve all plans and specifications for the project.
For the construction phase, the City’s portion will be a bid option, currently estimated at $366,000. At bid opening, the County will notify the City of the construction cost for the City’s portion. Upon agreement on the bid option amount, the City is required to provide funding to the County within fifteen business days in order to proceed with the award. The City is responsible for funding 100% of their construction costs, including change orders. The City will continue to maintain their right-of-way in perpetuity, including the constructed improvements. If the City determines not to proceed with the construction, the County will not award the bid option but will proceed with its capital improvement project.
The terms and conditions of this partnership are established in the Interlocal Agreement. In accordance with Administrative Order 29, the Agreement has been reviewed and approved by the County Attorney’s Office, Risk Management, and Purchasing Services. The City of West Melbourne approved the Interlocal Agreement at their March 18, 2025 Council meeting.
