Fiscal Impact:

Overall, positive impact due to less staff time to explain equivalent materials and acceptable construction practices. Requested Action:

Recommendation

It is requested that the Board of County Commissioners approve legislative intent and permission to advertise amendments to Chapter 62, Article VII, Division 1, Section 62-2802, entitled Exhibits, Brevard County Code of Ordinances.

End

Summary Explanation and Background:

Section 62-2802, Brevard County Code of Ordinances, provides minimum requirements for construction geometry, materials, and methods associated with development. Section 62-2802 provides as follows: “[t]he exhibits, 1 - 26, referred to in this article and adopted by reference and incorporated herein are part of this article and article VIII. The language of this article and article VIII shall control in the event of conflict between any figure contained in an exhibit.” These exhibits, however, have not been updated since 2008. Currently, many of the material references for asphalt and concrete are no longer commercially available or applicable, requiring staff to provide additional guidance to developers and contractors regarding acceptable equivalent materials. Additionally, as field conditions have changed, some standards need to be updated to ensure they are in line with current industry standards.

The proposed Code amendment will increase efficiency by allowing the Public Works Department to establish clearer expectations for developers and contractors. The amendment will clarify current requirements for construction geometry, materials, and methods; align the exhibits with currently accepted development standards and Public Works Department practices and policies; and ensure State-mandated changes that have been implemented since 2008 are being observed.

The proposed Code amendment will be brought before the BCAC and LPA prior to returning to the Board for final consideration.
