Recommendation

It is requested that the Board of County Commissioners: 1) approve and authorize the Chairman to initial page two of the attached Purchase Agreements, 2) execute the Addendums to the Purchase Agreements, 3) re-execute the Resolutions and County Deeds, and 4) Authorize the Interim County Manager or County Manager to execute all subsequent agreements, upon approval from the County Attorney’s Office and Risk Management, and all project-related documents to ensure timely delivery and responsiveness on FDOT’S Facility Improvement Project for State Road 528 East of State Road 524 (Industry) to East of State Road 3.

Summary Explanation and Background:

The subject property is located in Sections 10, 11, 14 and 15, Township 24 South, Range 36 East, on the north and south side of State Road 528 and the east and west side of North Courtenay Parkway.

 

The Board of County Commissioners, in regular session on December 3, 2024, executed and approved the Purchase Agreements with FDOT for portions of County owned parcels 110 and 112; executed and approved Resolution Nos. 24-130, 24-131, and 24-132; and executed and approved Deeds for parcels 110.01, 112.01, 100.01, 101.01 and 109.01 all related to FDOT Facility Improvements Project 4074023 of State Road 528 east from State Road 524 (Industry) to east of State Road 3.

 

Upon final review of the documents of Parcels 110 and 112 by FDOT, it was determined that the Addendums to the Contracts were inadvertently omitted. The verbiage on the Addendums pertain to routine language of terms of final settlement of all compensation and address personal property, if any.

 

During the review process by FDOT, legal updated the forms for the County Deeds and Resolutions for Parcels 100, 101, and 109. The updates included new standard language regarding additional rights, such as ingress, egress, light, air, and view. None of these updates affect the value of the parcels.

 

Upon discussions with FDOT for revised documents, Land Acquisition, under the direction of the Public Works Director, was able to successfully negotiate the revision of the design plans related to Parcel 109. Marine Harbor Drive primarily leads to commercial and residential areas. It is currently unpaved. The original FDOT design plans were to reconstruct and place RAP (Reclaim Asphalt Pavement). The revised plans will implement using the RAP material as a base course with the surface to be a Double Chip Seal treatment. This will result in cost saving benefits for future road improvements to Marine Harbor Drive.

 

The attached revised Contracts, Addendums, Deeds and Resolutions will correct and finalize the acquisition of these Parcels to FDOT.

 

The User Department approves this request.

 

This acquisition follows the policies and procedures as set forth in Administrative Order 37.

Clerk to the Board Instructions:

Upon execution by the Chairman, Public Works Department will contact the Clerk’s office to make arrangements to pick up the original executed Purchase Agreements, Addendums, Resolutions, and County Deeds.
