The applicant is requesting that the Board of County Commissioners grant a waiver of Section 62-3202(h)(10), which requires a 6-foot masonry or solid wall when commercial developments within a BU-1, BU-2, or Industrial zoning classification are adjacent to residential zoning to allow for fencing and vegetation along the southern and western property lines.  The Board’s approval of the waiver is subject to the criteria depicted below in the summary and background.

Summary Explanation and Background:

Section 62-3202(h)(10) stipulates that site plans within BU-1, BU-2, or Industrial zoning classifications shall construct a minimum of a six-foot high masonry or solid wall, including, but not limited to, concrete block walls, pre-cast (solid) walls, or foam core/steel support with stucco finish, when the subject property abuts a residential zoning classification.

 

The subject property is located adjacent to the west side of US Highway 1, approximately 0.4 miles south of Aurantia Road in Mims (tax account numbers 2004828 and 2004829). The property has a zoning designation of BU-2 (Retail, warehousing, and wholesale commercial.) Residential properties with a zoning designation of AU (Agricultural residential) abut the south and west sides of the subject property. The applicant proposes to provide a six-foot chain link fence and a twenty-foot landscape buffer in lieu of the required wall.

 

The applicant asserts that the property is in a rural location, and that a six-foot-high block wall is out of character for the area and would be injurious to the existing landscape vegetation. The applicant also states that fences and landscape buffers along property boundaries are common to the area, while walls are not. Reviewers in the Brevard County Natural Resources Management Department support the waiver, indicating that the existing and proposed fencing and vegetation provides adequate buffering.

 

Staff has not granted approval of the waiver and defers to the Board of County Commissioners. Board approval of the waiver is subject to the criteria depicted in the site plan 24SP00013 and providing the fencing and vegetation along the southern and western property lines. In addition, any future development, redevelopment, or alteration of the subject property that modifies the aforementioned site plan or reduces the vegetative buffer will void the wall waiver.
