It is requested that the Board of County Commissioners 1) approve and authorize the Chair to execute a contract between Brevard County and the Florida Department of Environmental Protection Petroleum Restoration Program upon approval by Purchasing, Risk Management, and the County Attorney’s Office; 2) authorize the County Manager to execute future contract amendments and/or renewals upon approval by Purchasing, Risk Management, and the County Attorney’s Office; 3) authorize the Local Program Manager to execute annual task assignments consistent with the contract.

Summary Explanation and Background:

Since 1987, Brevard County’s Natural Resources Management Department (NRM) has operated under contract with the Florida Department of Environmental Protection (DEP) to implement the State Underground Petroleum Environmental Response (SUPER) Act program, which protects surface water and drinking water supplies from petroleum contamination.

In FY 2004-2005, Brevard County’s contract was expanded to include program implementation in both Brevard and Indian River counties. In FY 2015-2016, St. Lucie, Martin, and Okeechobee counties were added to the area overseen by Brevard County staff. In FY 2023-2024, Volusia County was added for program management. The current contract, approved by the Board on May 17, 2016, will expire on June 30, 2026.

Currently, NRM manages 544 cleanup sites across the six counties under a task assignment totaling $1,580,209. This equates to an average of $3,105 per site, with funding prorated based on site complexity.

Proposed is a new five-year contract, including a renewal option for an additional five years, that will allow Brevard County to continue administering petroleum contamination cleanup activities in Brevard, Indian River, St. Lucie, Martin, Okeechobee, and Volusia counties. This contract will authorize NRM to continue protecting groundwater resources and the Indian River Lagoon watershed.

DEP fully funds program implementation. Execution of the contract will allow staff to negotiate the annual task assignment prior to the start of DEP’s fiscal year on July 1.
