Recommendation

In accordance with Section 62-2841(i) and Section 62-2844, it is requested that the Board of County Commissioners grant final plat approval and authorize the Chair to sign the final plat and contract for the Links at Indian River Preserve (Pod 8).

End

Summary Explanation and Background:

There are three stages of review for subdivision plan approval: the pre-application conference, the preliminary plat/final engineering plan review, and the final plat review. The pre-application conference for the above project was held on August 27, 2020. The preliminary plat and final engineering plans, which is the second stage of approval, were conditionally approved on June 9, 2025. The third stage of review is the final plat approval for recordation. The applicant is posting a performance bond and contract for guarantee of the completion of the infrastructure improvements.

Staff has reviewed the final plat and contract for the Links at Indian River Preserve (Pod 8) a single-family residential subdivision and has determined that it complies with the applicable ordinances.

The Links at Indian River Preserve (Pod 8) is located in Mims on the east side of Indian River Pkwy, north of W Main St (SR 46), east of I-95. This subdivision consists of 41 single family detached lots within 26.16 acres. Potable water and sanitary sewer service for the subdivision will be provided by Brevard County. Caspian Road and Pandion Place will be privately maintained rights-of-way.

It should be noted that a development agreement dated May 19, 2020, entered into by Indian River Preserve Estates Corp. and the Brevard County Board of County Commissioners, states that the developer or its successors “shall at the Developer’s sole expense cause the unpaved remainder of Tract G west of Indian River Drive to be constructed as a paved private roadway to also provide access the County’s waste water treatment plant . . .Failure by Developer to complete the terms of this Agreement may result in County withholding permits and approvals necessary to plat and construct Pods 8 and 11.”  While the Developer has not constructed the private road as of November 2, 2026, the Developer has bonded the construction of this road to warrant its representation that it will meet its obligations under the Agreement, and staff has no objection to approval of POD 8.

This approval is subject to minor engineering changes as applicable. Board approval of this project does not relieve the developer from obtaining all other necessary jurisdictional permits.
