It is requested that the Board authorize the Chair to execute the following agreement, subject to approval by the County Attorney of final documents substantially in the form of the attached: First Amendment to BOEM Negotiated Agreement No. OCS-A 0554, the Memorandum of Agreement Among the Bureau of Ocean Energy Management (BOEM) and the U.S. Army Corps of Engineers and Brevard County Board of County Commissioners, Regarding the Use of Outer Continental Shelf Sand Resources for Shore Protection and Restoration; and authorize the Chair to sign any future time extensions to this agreement that may be required for project completion, subject to County Attorney approval.

Summary Explanation and Background:
On April 20, 2000, Brevard County executed a Project Cooperation Agreement with the U.S. Army Corps of Engineers for initial construction and periodic renourishment of the North and South Reaches of the Brevard County Shore Protection Project over the 50-year life of the Project. On August 31, 2016, Brevard County entered into a Project Partnership Agreement with the Army Corps adding the Mid Reach segment to the Brevard County Shore Protection Project. The Project successfully protected upland property within the project area during Hurricanes Ian and Nicole but suffered significant beach erosion. The County worked with the U.S. Army Corps of Engineers to quantify storm related beach erosion within the area and seek emergency restoration funds. Costs for the work are approximately $18M for the 3.8 mile South Reach and $38M for the 7.8 mile Mid Reach. This project is 100% Federally funded, no County funds are required by the Army Corps to complete this beach construction.
The Corps planned to renourish both reaches between November 2023 and May 1, 2025. In order to complete this project, multiple agreements were executed with the Army Corps to utilize Flood Control and Coastal Emergency funding and a three-party memorandum of agreement with the Army Corps and BOEM to allow use of the offshore sand. These agreements were authorized by the Board on July 25, 2023.
Unfortunately, there have been several delays with project completion. Renourishment of the Mid Reach was finished in spring 2025 with plans to complete renourishment of the South Reach in spring 2026. However, due to unforeseen circumstances the Army Corps and their contractor were unable to complete sand placement on the South Reach by May 1, 2026, and will need to extend the project into winter 2026/2027. Therefore, it is requested the Memorandum of Agreement between Brevard County, the Army Corps and BOEM be extended to May 7, 2027 to allow for project completion of the South Reach.
The Amendment to extend the current Agreement is attached for consideration by the Board. Approval and execution of this amendment is essential before the current Agreement expires on August 11, 2026, for the project to continue. Final copies for review and execution cannot be provided until the federal review/approval processes are complete. Final documents will be approved by the County Attorney’s Office prior to execution by the Chair.
