Fiscal Impact:

The Project is estimated to cost $1,607,034. The County is responsible for costs associated with its roadway segments, estimated at $745,904. Funding for the County’s portion is budgeted in the FY26 Capital Improvement Plan for Resurfacing and Reconstruction. The City shall be responsible for all costs associated with its roadway segments, estimated at $861,130. The City will provide funding for its segments to the County prior to construction commencement. The City is also responsible to fund 100% of change orders for its segments.

Requested Action:

Recommendation

It is requested that the Board of County Commissioners: 

1) approve and authorize the Chair to execute the Interlocal Agreement with the City of Palm Bay for the Babcock Street Reconstruction and Resurfacing project;

2) authorize the County Manager to execute any necessary agreement-related documents, such as amendments, and conveyance documents, contingent upon review and approval by the County Attorney’s Office, Risk Management, and Purchasing Services; and

3) authorize the County Manager to execute all necessary Budget Change Amendments (BCRs).

Summary Explanation and Background:

The County and the City of Palm Bay previously entered into an interlocal agreement for the St. Johns Heritage Parkway (SJHP) Intersection and Babcock Street which was recorded on April 30, 2020. Since then, the City completed the SJHP Intersection improvements. The 2020 interlocal agreement also outlined the long-term responsibilities for Babcock Street. The County and the City  wish to reconstruct and resurface Babcock Street between Weiman Road and Willowbrook Street. The new Interlocal Agreement carries out certain obligations of the 2020 interlocal agreement and establishes the terms and conditions for the reconstruction and resurfacing of the portion of Babcock Street between Weiman Road and Willowbrook Street.

 

The County and City have jurisdiction and functional authority over certain portions of Babcock Street, as shown in Attachment A of the Interlocal Agreement. The Parties agree that the County will be the lead agency. Additionally, the County also has the authority to enter into appropriate contracts to perform the work associated with the project. The City agrees to fully cooperate with and support the County’s work efforts associated with the project.  The City will conduct inspections on the segments that are within its jurisdiction and functional authority. The Parties will complete the transfer of ownership and maintenance responsibilities of the County-owned segment of Babcock Street from the County to the City as outlined in the 2020 interlocal agreement.

 

The terms and conditions of this reconstruction and resurfacing of Babcock Street project are established in the new Interlocal Agreement. The City of Palm Bay approved the Interlocal Agreement at their January 8, 2026 Council meeting. In accordance with Administrative Order 29, the Agreement has been reviewed and approved by the County Attorney’s Office, Risk Management, and Purchasing Services.
