It is requested that the Planning and Zoning Board conduct a public hearing to consider a change of zoning classification from AU (Agricultural Residential) to RR-1 (Rural Residential)

Summary Explanation and Background:

The applicants are requesting to rezone a 1.5 acre parcel from AU (Agricultural Residential) to RR-1 (Rural Residential) to have the zoning classification consistent with the parcels’ lot size.  The parcel was split from a 4 acre parent parcel into the current configuration on August 16, 2023.  The split from the parent parcel made both lots that are substandard to the AU lot size requirements.

 

Per Section 62-2102, Brevard County Code of Ordinances, no person shall sever any lot in such a manner that a violation of any of the provisions of the Land Development Code would be created on any new or altered lot, including their uses or structures.

 

The proposed RR-1 zoning requires an area of not less than one acre, having a lot width of not less than 125 feet and a lot depth of not less than 125 feet.  The RR-1 classification permits horses, barns and horticulture as accessory uses to a single-family residence.  The minimum house size is 1,200 square feet. Keeping of horses and agricultural uses are accessory to a principal residence within the RR-1 zoning district.

 

North and West of the subject property is agricultural, zoned AU; South across Dairy Rd. is agricultural with AU zoning.  East is a single-family residence with RR-1 zoning.

 

The Board may wish to consider if the request is consistent and compatible with the surrounding area.

 

The Board of County Commissioners will consider the request on Thursday, October 3, 2024. Beginning at 5:00 p.m. The meeting will be held at the Brevard County Government Center, 2725 Judge Fran Jamieson Way, Commission Room, Viera, Florida.
