It is requested that the Board of County Commissioners approve and authorize the Chair to execute the attached Resolution and Deed of Conservation Easement for Local Governments. A majority-plus-one vote by the Board is required in order to grant this request.

Summary Explanation and Background:

The subject property is located in Section 36, Township 23 South, Range 36 East, on the north side of Hall Road in Merritt Island.

 

The Public Works Department is undertaking a capital improvement intersection project for the intersection at Wickham Road and Pineda Causeway. Certain improvements require a permit from St. Johns River Water Management District (SJRWMD). As a condition of the permit, the County is required to mitigate wetland impacts by providing a 5.36 acre Conservation Easement.

 

The Natural Resources Management Department is the custodian of County owned property located on Hall Road in Merritt Island. The Department has previously used this property for mitigation for other County projects. The Department supports this request.

 

A majority-plus-one vote by the Board is required in order to grant this request.

 

The User Department approves this request.

 

This transaction follows the policies and procedures as set forth in Brevard County Administrative Order 37; Section 704.06 Florida Statutes; Section 10.3.8 Environmental Resource Permit Applicant’s Handbook, Volume 1 (October 1, 2013) and Fla. Admin. Code R. 62-330.301 (6).

Clerk to the Board Instructions:

Upon execution by the Chair, Public Works Department will contact the Clerk’s office to make arrangements to pick up the original executed Resolution and Deed on Conservation Easement for Local Governments.
