It is requested that the Board of County Commissioners approve and authorize the Chairman to execute the attached Resolution and Deed of Conservation Easement for Local Governments.

Summary Explanation and Background:
The subject mitigation property is located in Section 36, Township 23 South, Range 36 East, on the north side of Hall Road in Merritt Island.
The Public Works Department is undertaking an intersection improvement project for the intersection at Wickham Road and Pineda Causeway. Certain improvements require a permit from St. Johns River Water Management District (SJRWMD). As a condition of the permit, the County is required to mitigate wetland impacts by providing a 5.36 acre Conservation Easement.
The Environmentally Endangered Lands Program (EEL), a program under the Parks and Recreation Department, is the custodian of County owned property located on Hall Road in Merritt Island. EEL has previously allowed use of this property for mitigation for other County projects. A one-time management fee of $2,680.00 will be paid to the EEL Program. The Program supports this request.
The User Department approves this request.
This transaction follows the policies and procedures as set forth in Brevard County Administrative Order 37; Section 704.06 Florida Statutes; Section 10.3.8 Environmental Resource Permit Applicant’s Handbook, Volume 1 (October 1, 2013) and Fla. Admin. Code R. 62-330.301 (6).
Clerk to the Board Instructions:
Upon execution by the Chairman, Public Works Department will contact the Clerk’s office to make arrangements to pick up the original executed Resolution and Deed of Conservation easement for Local Governments.
