It is requested that the Board grant legislative intent and permission to advertise amendments to Article VI, Subdivision V, Zoning Regulations regarding PUD zoning.

Summary Explanation and Background:

The PUD zoning classification is meant to be a flexible classification that allows a developer, through a process, to essentially design a unique zoning framework that is applied to a specific area.  This is accomplished by allowing uses, setbacks, and other development standards that would otherwise not be allowed in a standard zoning classification, with certain protections and criteria in place that further the interests of the public given the specific circumstances of the development in question.

 

In discussions with staff and potential users of this code, it has become clear that the current process is not user friendly, is difficult to administer for staff, and confusing for applicants to utilize.  The proposed amendments are to include process changes to help streamline it, including by incorporating more flexibility and new PUD categories.

 

It is proposed to issue legislative intent and permission to advertise amendments to Article VI, Subdivision V of the Brevard County Code of Ordinances, and to direct staff to re-write the PUD code while allowing them enough flexibility to research the processes and procedures of other jurisdictions and choose a model that would best fit Brevard County.
