Request the Board approve the attached Agreement and authorize the Chair to sign the Agreement and authorize the County Manager to sign any necessary contract amendments, upon review and approval by the County Attorney’s Office, Risk Management and Purchasing.

Summary Explanation and Background:

The Sheriff requested that the County and the College enter into an agreement defining the roles and responsibilities of the Parties with regards to the “ShootHouse,” which is set up on one of the Sheriff’s training ranges at Pluckebaum Farm.  The County leases the land to the Sheriff, and the current lease runs through October 15, 2025.  The ShootHouse, which provides a 360 degree ballistically safe firearms training environment for law enforcement officers, was originally purchased through a collection of funds from the College, the Sheriff and the State Trust Fund in the late 1980s.  Until recently, it was managed by the College. Currently, the ShootHouse needs some capital repairs to remain viable.  In this agreement, the Sheriff agrees to (a) fund the capital improvements, (b) assume responsibility for running the site, and (c) agrees to be responsible for maintenance and proper cleanup of the site.  The College cedes any rights it may have to the ShootHouse and has agreed that any future use will be coordinated through the Sheriff. The County, as landlord, is acknowledging the Sheriff’s right under the lease to continue to operate the ShootHouse on the land, and has ensured the roles and responsibilities of each Party are well-defined.
