Authorize the Chair to execute a License Agreement between the City of Melbourne and Brevard County for overlapping use between 1311 E. New Haven and Front Street Park.

Summary Explanation and Background:
The Brevard County Natural Resources Management Department uses County property at 1311 E. New Haven as office space for department employees. This property holds a roughly 1,200 square foot Annex building, with an attached 240 square foot open-air porch. Space constraints within the building, and lack of indoor common space, has led Department staff to use the porch as a meeting space.

The outdoor meeting space, with no cover, causes challenges when inclement weather coincides with planned meeting times. As a cost-effective solution to this meeting space problem, a quote was obtained through County Facilities to erect a simple aluminum roof and screen-in the existing porch and funding was allocated in the budget. During the permitting process it was discovered that the corner of the long-existing porch slab extends just over the property line onto land owned by the City of Melbourne at Front Street Park.

The City has inspected the area and determined that the slab, in place for decades, does not cause undesirable impacts to the City's Front Street Park property. The City has determined that the attached Licensing Agreement would be a satisfactory mechanism to allow the County continued use of the existing porch at 1311 E. New Haven, and to allow permitting of a screen structure over the porch if the County desires. Permission is requested for the Chair to execute the attached no-cost licensing agreement.
