It is requested that the Board of County Commissioners approve and accept the attached Sidewalk Easement, Drainage Easement and Temporary Drainage Easement.

Summary Explanation and Background:

The subject property is located in Sections 27 and 28, Township 26 South, Range 36 East, west of I-95 along Pineda Causeway, Lake Andrew Drive and Pineda Boulevard in Viera.

The Viera Company is developing the area west of Interstate 95 along Pineda Causeway and Lake Andrew Drive in Viera. The ponds and underground stormwater pipes that serve the roadway improvements are located within adjacent, proposed neighborhoods that are currently under development, or in the design and permitting stage at the time of the Lake Andrew project, and will not be platted until after the roadway improvements are completed and conveyed to the County. The attached Temporary Drainage Easement is necessary to facilitate development and shall automatically terminate upon the recording of a subdivision plat in the public records containing permanent drainage easement dedications to the County. The attached Drainage Easement is located just south of the Bridgewater Plat boundary and is required.

Due to the geometry, signalization improvements and turn lanes of the intersections of Lake Andrew Drive and Pineda Extension, sidewalk easements are required, and in most cases, are small encroachments outside the right-of-way.

The User Department approves this request.

This acquisition follows the policies and procedures as set forth in Administrative Order 37.
