It is requested that the Board of County Commissioners approve and authorize the Chair to execute the attached Resolution and County Deed.

Summary Explanation and Background:

The subject properties are located in Section 12, Township 28 South, Range 36 East, Section 1, Township 28 South, Range 36 E and Section 6, Township 28 South, Range 37 East, in the City of West Melbourne.

Public Works Department desires to convey ownership and maintenance to City of West Melbourne for: 1) the portion of Fell Road from the Max K. Rodes Park to Minton Road, 2) Meadowlane Avenue, and 3) Helen Street east of Minton Road. The City of West Melbourne desires to accept the transfer and as such applied for a conveyance of the transfer. It has been determined by the County that the transfer is in the best interest of the County and the property’s use for roadway purposes will promote public health, safety or welfare; and will serve the public interest and a public purpose. The attached Resolution is pursuant to Section 125.38, Florida Statute authorizing the conveyance of County property. The attached County Deed will effectuate the transfer of ownership and maintenance to the City, together with associated drainage systems.

The User Department approves this request.

This acquisition follows the policies and procedures as set forth in Administrative Order 37.

Clerk to the Board Instructions:

Upon execution by the Chair, Public Works Department will make arrangements to pick up the original executed Resolution and original executed County Deed from the Clerk’s office.
