Recommendation
It is requested that the Board of County Commissioners: 1) accept and authorize the Chair to execute the attached Contract for Sale and Purchase and Amendment 1 to Contract for Sale and Purchase, and 2) waive Administrative Order A037, paragraph C3, requirement for a Phase I environmental site assessment.

Summary Explanation and Background:
The subject property is located in Section 18, Township 27 South, Range 37 East, on the north side of Kingston Lane in Melbourne.

The Department previously acquired a parcel as part of the Kingsmill-Aurora Phase II Project, in order to design and construct a water treatment train consisting of north and south ponds, divided into multiple settling and polishing pools. The treatment train, currently in design, will reduce excess nutrients and sediments that currently discharge into the Indian River Lagoon through a major tributary to the Eau Gallie River. This acquisition at $2,000 is needed to provide a more cost-effective construction (near term savings) and maintenance access (long term savings) for the south pond. The initial construction and ongoing maintenance savings resulting from this acquisition are expected to greatly exceed the cost of the acquisition.

Amendment 1 to Contract for Sale and Purchase allows for the option of a title insurance commitment and corrects the Plat No. from 6A to 6 on the legal description.

The User Department approves this request.

This acquisition follows the policies and procedures as set forth in Administrative Order 37.
